vendoriohighia provides custom pixel art illustrations and digital artwork services. We create original artwork based on client specifications and requirements. Our services include pre-made pixel art products, custom artwork creation, and related digital design services. All services are provided "as is" and we make no guarantees regarding specific outcomes or results.

Intellectual Property Rights

All pixel art created by vendoriohighia, including but not limited to characters, scenes, icons, and other digital artwork, remains our intellectual property until full payment is received. Upon completion of payment:

  • Clients receive a non-exclusive, non-transferable license to use the purchased artwork as specified in their purchase agreement
  • Commercial use rights are granted for the specific project(s) outlined in the agreement
  • Clients may modify purchased artwork for their own use, but may not claim original authorship
  • Redistribution or resale of artwork as standalone products is prohibited without written permission

vendoriohighia retains all copyright and intellectual property rights to the original artwork. Unauthorized reproduction, distribution, or creation of derivative works may result in legal action.

User Conduct and Prohibited Uses

You agree not to:

  • Reproduce, distribute, or create derivative works from our pixel art without proper authorization
  • Use our services for any unlawful purpose or in violation of any applicable laws
  • Use our artwork in connection with content that is defamatory, obscene, or harmful
  • Attempt to reverse engineer, decompile, or extract source code from our digital products
  • Use automated systems or bots to access our website or services

Payment Terms

All prices are listed in United States Dollars (USD). Payment is required before delivery of digital products. For custom projects, a deposit may be required. We accept major credit cards and other payment methods as indicated during checkout. All sales are final unless otherwise specified in our Return Policy.

Limitations of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, vendoriohighia SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OUR SERVICES OR WEBSITE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Indemnification

You agree to indemnify, defend, and hold harmless vendoriohighia, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of our services, violation of these terms, or infringement of any rights of another party.

Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these terms or our services shall be resolved in the state and federal courts located in Los Angeles County, California.
